PART I: PRIVACY POLICY
1. Scope of This Policy
This Privacy Policy applies to all users of FLUXARA, including purchasers of time-limited Insight packages and the Lifetime Research Access tier. FLUXARA operates as a knowledge-based analytical system, not a consumer SaaS product with recurring usage guarantees.
2. Information We Collect
2.1 Personally Identifiable Information (PII)
We may collect:
- Full name
- Email address
- Billing-related identifiers (processed exclusively by third-party gateways such as Stripe or PayPal)
FLUXARA does not store credit card numbers or sensitive payment credentials.
For Lifetime Mastery Academic, additional information may be voluntarily provided by the user for research calibration purposes, including:
- Date-based identifiers (e.g., founding date, personal birth date)
- Organizational metadata (company name, industry classification)
These data points are used solely for generating custom analytical documents and are never resold or reused.
Note: The public FLUXARA website may use anonymized analytics and advertising services to improve site experience. Materials marked as "Secret" and documents delivered as part of Lifetime Mastery are provided without third‑party advertising and are not subject to user‑level behavioral ad tracking; any operational analytics related to delivery are anonymized and not linked to purchaser PII.
2.2 Usage & Interaction Data
We may collect:
- IP address
- Device/browser metadata
- Pages accessed
- Purchased Insight types
- Email communications related to delivery and support
3. How We Use Information
Collected data is used to:
- Grant access to purchased Insights or documents
- Deliver custom research outputs (PDFs, credentials, API access)
- Improve system structure and documentation clarity
- Comply with legal and regulatory obligations
FLUXARA does not use personal data for advertising resale or profiling.
4. Data Security
We implement reasonable technical and organizational safeguards. However, users acknowledge that no digital transmission or storage method is 100% secure, especially when involving emailed documents and encrypted archives.
5. Data Sharing
We do not sell or rent personal data. Limited sharing may occur only with:
- Payment processors
- Infrastructure providers (hosting, analytics)
- Legal authorities when required by law
6. Data Retention
We retain your Personally Identifiable Information (PII) only for as long as necessary to provide our services, maintain your active Pro License or API subscription, and comply with legal, tax, or accounting obligations. If you request account deletion, your personal data will be permanently purged or fully anonymized within 30 days, unless a longer retention period is required by law.
7. User Rights (GDPR & CCPA)
Under applicable global privacy laws (including GDPR and CCPA/CPRA), you have the right to:
- Access: Request access to the personal data we hold about you.
- Rectification: Request correction of inaccurate or incomplete data.
- Erasure (Right to be Forgotten): Request the deletion of your personal data.
- Opt-Out: Opt-out of the "sharing" of your data for targeted advertising (managed via our Cookie Consent banner).

PART II: TERMS OF SERVICE
1. Acceptance of Terms
By accessing or purchasing any FLUXARA product, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must not proceed with access or purchase.
2. Service Definition
FLUXARA provides Momentum & Energy Cycle Insight Data, including but not limited to:
- Cyclical structures
- Momentum phases
- Temporal stress points
- Long-range energy distributions
Delivery formats include Time-limited Insight posts, research documents, API-based data access, and Custom analytical PDFs (Lifetime Mastery Academic). FLUXARA operates across multiple temporal resolutions (1 Day → 10 Years), each with explicitly different accuracy characteristics.
2.1 Product Categories
FLUXARA offers the following product categories, each subject to specific terms outlined in this document:
- Pro License Tiers (Personal / Strategist / Grandmaster): Perpetual software licenses granting access to the FLUXARA-1 analysis engine at varying capability levels, each including a specified amount of Energy credits.
- Energy System: Consumable units powering Cycle of Destiny (CoD) analysis. 1 Energy = 1 Year of analysis; 1 CoD = 10 Energy = $100 at retail rate.
- Energy Refill Packs (Single / Standard / Whale): One-time purchases to replenish Energy balance, available at retail or volume-discounted rates.
- Pioneer Upgrade Voucher: A one-time-use, 50% discount voucher exclusively available to qualifying Early Access tier holders for upgrading to a Pro License.
- Lifetime Mastery Academic (LMA): A manual, application-based research access tier, delivered via encrypted documents and credentials. See §4.2 for specific terms.
- Enterprise API Subscription: Annual B2B service delivering JSON-formatted analytical outputs, integration documentation, and usage guidelines — subject to individual negotiation and prepaid annual billing.
3. Intellectual Property
All content, models, diagrams, terminology, and analytical frameworks are the exclusive intellectual property of FLUXARA. Purchasing any product grants access rights only, not ownership, redistribution, or derivative rights.
Definitions: "Methodology" refers to documentary materials, theoretical descriptions, interpretive models, and explanatory documentation. "Core technology" refers to source code, proprietary algorithms, model weights, system deployments, and other deployable artifacts. Unless explicitly stated in a separate written agreement, purchase of any tier (including Lifetime) does not transfer ownership of core technology, source code, model weights, or grant rights to resell or relicense the underlying software.
License: Lifetime access provides a perpetual, non-transferable, non-exclusive right to access and use documentary materials for personal research and internal organizational purposes. Commercial redistribution, white‑labeling, sublicensing, or offering the methodology as a service to third parties requires a separate written agreement.
4. Payment, Delivery & Refund Policy
4.1 General Policy
Due to the nature of digital informational products, purchases are generally considered final once the content or credentials are delivered. However, FLUXARA will consider refund or remediation requests where a customer can demonstrate a failure of delivery or material non-conformity within 14 days of delivery. Requests received after this period will be handled on a case-by-case basis and may be refused.
4.2 Lifetime Mastery Academic – Special Conditions
The Lifetime Mastery Academic is a manual, application-based research access, typically delivered via encrypted PDF documents and credentials, and customized per individual or organization. Because delivery often includes one‑off, non-reproducible materials and bespoke analyst effort, refunds are more limited than for off-the-shelf items.
- Immediate intellectual disclosure of documentary materials
- Custom research effort to produce personalized reports
- Deliverables that may be non-reproducible in identical form
Refunds or cancellations for Lifetime deliveries are considered only where a customer demonstrates failed delivery or a material defect within 14 days of receipt. FLUXARA reserves the right to investigate claims and may require evidence (order records, email confirmations, document hashes, or delivery logs). Chargebacks initiated through payment processors will be contested where valid delivery records exist.
4.3 Pro License Tiers (Personal / Strategist / Grandmaster)
- Purchases are final and non-refundable once the license key is activated on the user's account.
- Each license grants perpetual, non-transferable, non-sublicensable access to FLUXARA-1 analysis tools at the tier level purchased.
- Energy credits included with the license are credited immediately upon activation. Consumed Energy cannot be refunded under any circumstances.
- The Grandmaster tier includes a voucher privilege for fixed-rate Lifetime Academic access ($9,999). This voucher right is bundled with the Grandmaster license and is non-transferable and non-refundable separately.
- Tier upgrades may be available by paying the price difference between tiers; downgrades and partial refunds for tier differences are not available.
- A refund may be considered only if license activation fails due to a verified platform error, the request is made within 7 days of purchase, and proof of failed activation is provided.
4.4 Energy Refill Packs (Single / Standard / Whale)
- Energy is a consumable digital asset. Once credited to the user's account, Energy is non-refundable regardless of whether it has been consumed.
- Unused Energy does not expire and remains in the account indefinitely.
- Bulk discount pricing (Standard at 40% savings, Whale at 50% savings) reflects volume purchase savings. Partial refunds for unused portions of discounted packs are not available.
- If Energy credits fail to appear within 24 hours of a confirmed purchase, users should contact support with their order confirmation for resolution.
- FLUXARA reserves the right to adjust Energy pricing for future purchases. Existing credited Energy is not affected by price changes.
4.5 Pioneer Upgrade Voucher (Early Access Exclusive)
- The Pioneer Upgrade Voucher is a one-time-use, non-transferable discount applied exclusively at checkout for qualifying Early Access key holders.
- Once redeemed, the voucher is permanently consumed. No reversal, re-issuance, or transfer to another account is possible.
- The discounted purchase follows the same refund terms as §4.3 (Pro License Tiers).
- Voucher validity may be time-limited or revoked at FLUXARA's discretion. Expired or revoked vouchers carry no residual value.
4.6 Enterprise API Subscription (B2B Annual Service)
- API access is provided under annual subscription agreements negotiated individually with each enterprise client.
- All subscriptions require full prepayment for the annual term before API credentials are issued.
- API outputs (JSON data, analytical reports, integration documentation) are licensed for the subscriber's internal use only. Redistribution, resale, sublicensing, or white-labeling of API outputs requires a separate written agreement.
- Prepaid annual fees are non-refundable once API credentials are activated. If activation is delayed due to a platform error, FLUXARA will extend the subscription term accordingly.
- Rate limits and usage quotas are subject to the negotiated service agreement. Exceeding agreed quotas may result in temporary throttling or additional charges as specified in the agreement.
- Unless explicitly stated in a separate written Service Level Agreement (SLA), FLUXARA does not guarantee specific uptime percentages, response times, or data delivery schedules for API access.
- FLUXARA reserves the right to terminate API access for violations of terms, including but not limited to: unauthorized redistribution of outputs, reverse engineering of analytical models, or use of API data to build competing services.
- All analytical models, algorithms, and proprietary methodologies underlying API outputs remain the exclusive intellectual property of FLUXARA. The subscriber receives a license to use the output data, not ownership of the underlying technology.
5. Service Availability, Modifications & "Lifetime" Definition
5.1 Definition of "Lifetime"
Where a product or tier is labeled as "Lifetime" (e.g., Lifetime Access, Pro License), "Lifetime" refers exclusively to the active operational lifespan of the FLUXARA product and its supporting infrastructure, not the biological lifetime of the purchaser. A Lifetime license guarantees access for as long as FLUXARA chooses to maintain and offer the service.
5.2 Discontinuation, Bankruptcy & Business Transitions
- Right to Terminate: FLUXARA reserves the right to modify, suspend, or completely discontinue the service, its servers, or its underlying algorithms at any time, due to bankruptcy, insolvency, strategic pivots, or any other business reason.
- Business Model Changes: FLUXARA reserves the right to transition its business model (e.g., from one-time licenses to recurring subscriptions). In such events, existing "Lifetime" license holders will retain access to the specific version/features they purchased, or be offered a grandfathered transition plan, but are not guaranteed free access to future fundamentally different versions or new subscription-gated features.
- Unused Energy & Assets: In the event of a total service shutdown or bankruptcy, all unused Energy credits, Vouchers, and Lifetime access privileges will immediately expire without compensation, cash value, or refund obligations. Where feasible, FLUXARA will attempt to provide a 30-day notice via email or website announcement prior to permanent shutdown.
6. Limitation of Liability & Founder Protection
FLUXARA shall not be liable for financial losses, business decisions, opportunity costs, or misinterpretation/misuse of data. All insights are provided “as-is”, without warranties of outcome, performance, or correctness in real-world execution.
To the maximum extent permitted by applicable law, under no circumstances—including project abandonment, bankruptcy, corporate dissolution, or force majeure—shall the founders, developers, officers, or affiliates of FLUXARA be held personally liable for any direct, indirect, incidental, or consequential damages, nor for the refund of any purchases, Lifetime licenses, or Energy credits.
PART III: DISCLAIMER
1. Product Purpose & Positioning
1.1 Not Financial Advice
FLUXARA is not an investment advisory service, a trading signal provider, or a profit prediction engine. No content should be interpreted as:
- Buy/Sell instructions
- Guaranteed outcomes
- Risk-free strategies
1.2 Academic & Strategic Nature
FLUXARA functions as a conceptual energy-mapping framework, a strategic reference system, and a tool for understanding cyclical momentum, not controlling it. It is designed for interpretation, reflection, and strategic alignment, not mechanical execution.
2. Risk, Error & Temporal Decay
Users acknowledge that:
- Shorter timeframes carry higher volatility and error margins.
- Accuracy decreases from long-cycle analysis to short-cycle signals.
- Insights must never be used in isolation.
FLUXARA IV (1 Day) is explicitly unsuitable for high-leverage or impulsive decision-making.
3. Responsibility & Agency
All decisions and consequences remain solely with the user. FLUXARA does not shape destiny. It reveals patterns of motion — interpretation and action belong to the Seeker.
4. Lifetime Mastery Academic Disclaimer
The Lifetime Mastery Academic represents access to a closed body of methodological knowledge and a research relationship, delivered as documentary materials and personalized reports rather than a transfer of code or deployable software. This is not a subscription to software; it is perpetual access to documentary and academic outputs.
Where FLUXARA determines that a deliverable contains sensitive proprietary details beyond public materials (for example, internal algorithm descriptions or non-public process documents), delivery will require a separate non-disclosure agreement (NDA) and explicit written consent before release.

5. Platform & SaaS Disclaimer
5.1 General Platform Disclaimer
- FLUXARA is provided "as-is" and "as-available" without warranty of uninterrupted service, uptime guarantees, or error-free operation.
- Scheduled and emergency maintenance may temporarily restrict access to the platform, analysis tools, and API services without prior notice.
- FLUXARA does not guarantee specific analytical accuracy. All outputs are probabilistic interpretations based on proprietary models, not deterministic predictions or certainties.
- Users are solely responsible for all decisions made based on FLUXARA outputs — including but not limited to investment, trading, hiring, strategic planning, or resource allocation decisions.
- FLUXARA accepts no liability for financial losses, missed opportunities, business disruptions, or adverse outcomes resulting from use of the platform, its outputs, or reliance on its analytical models.
- Enterprise and B2B users acknowledge that FLUXARA does not constitute professional financial, legal, tax, or investment advice and should not replace qualified professional counsel.
5.2 API-Specific Disclaimer
- API output data reflects the state of FLUXARA's analytical models at the time of generation. Outputs may vary as models are refined, updated, or recalibrated over time.
- FLUXARA does not warrant that API outputs are suitable for any specific use case, regulatory requirement, compliance framework, or industry standard.
- Integration of API outputs into third-party systems, dashboards, trading bots, or automated decision engines is at the subscriber's sole risk and responsibility.
- FLUXARA is not liable for downstream consequences arising from automated decisions made by systems consuming API data, including but not limited to financial losses, regulatory penalties, or operational failures.
